Your use of MetService’s Apps

These Terms of Use apply to MetService’s Apps namely, the MetService App, MetService Marine and MetService Rural Weather. These Terms are to be read in conjunction with MetService’s End User License Agreement. Please read these Terms prior to using the Apps. By accessing and using MetService’s Apps you accept these Terms of Use.

Changes

MetService may change these Terms without notice at any time by updating them on this website. These changes will be effective immediately. Because of this, we recommend checking this page from time to time. By continuing to use the Apps following an update, you agree to the changed Terms.

Access to Information         

You may use MetService’s Apps, and the information contained within them for your own personal use. Using this information for commercial purposes, except for open access data, is not permitted. Furthermore, the information must not be used for unlawful purposes. It must not be altered, resupplied, or used to train artificial intelligence in any way.

Your Responsibilities

Do not attempt to damage, reverse engineer,  introduce anything, decode, or extract the source code of the Apps.

Access and download the Apps only through approved stores. You are responsible for any data charges incurred by using our services. You indemnify MetService against all loss that MetService suffers or incurs as a direct or indirect result of your failure to comply with these Terms.

Intellectual property

The copyright for all text, photographs, logos, graphics, recordings, information and all other elements of the application are owned by the Meteorological Service of New Zealand Limited unless labelled as another party’s property.

Except to the extent expressly permitted by these Terms, you must not adapt, copy, distribute, display, publish, reproduce, or create adaptations or derivative works from any part of these Apps. All suggestions, feedback and recommendations provided by users to improve the Apps are the property of MetService.

Liability

Uncertainty is inherent in weather forecasts. MetService leverages its expansive data inputs to allow the expertise of its meteorologists to flourish. However, the result of this is still just highly informed opinion.

Consequently, MetService gives no warranty, guarantee or representation that the Apps are accurate, complete, current, or fit for any purpose.

Further, to the maximum extent permitted by law you access and use these Apps at your own risk. MetService has no liability or responsibility for any loss in connection with:

1. any weather forecasts provided on the Apps.
2. the Apps being unavailable (in whole or in part), delayed or error-prone from time to time.
3. MetService changing, suspending, discontinuing, or restricting access to the Apps without notice.
4. any linked website.
5. any site linked from the Apps . Links on the Apps are not MetService’s endorsement, approval, or recommendation of those sites. MetService does not have any responsibility for the content of those sites.

This exclusion applies regardless of whether liability or responsibility arises in contract, tort (including negligence), equity, breach of statutory duty, or otherwise. In cases where MetService’s liability cannot be excluded, MetService’s liability is limited) to the cost of remedying or replacing the defective information.

MetService also reserves the right to, without notice, change or eliminate a feature, update the software and make any free part of the App a paid service without any liability to the user whatsoever. 

Furthermore, MetService makes no representation or warranty that the Apps are appropriate or available for use in all countries or that the content satisfies the laws of all countries. You are responsible for ensuring that your access to and use of these Apps are not illegal or prohibited. You are also responsible for complying with applicable local laws.

Notifications

We’ll make our best efforts to get notifications to you. You accept that MetService cannot guarantee the receipt or provision or notifications and has no liability or responsibility associated with the information provided or accessed, or information not provided. MetService is not responsible for any information supplied by any third party.

Ad Free Subscription

MetService is offering the opportunity to purchase a 'display ad free' subscription in the MetService NZ Weather Android and iOS apps for a limited time and may modify or withdraw the offer at any point.  The pricing and terms applicable at the time of purchase will apply.  The offer does not apply to any other MetService app or website.

Purchasing the annual ad free subscription provides a minimum of 1 year/365 days of access to the 'display ad free' version of the app from the date of purchase.

Purchasing the monthly ad free subscription provides a minimum 1 year/365 days of access to the 'display ad free' version of the app from the date of purchase as long as all monthly payments are made in a timely manner.  If the monthly payment is terminated, access to the ad free version of the app will end at the end of the next billing period and/or any grace period applied by the app store. 

Subscription access and pricing may depend on the country your App Store Account or Play Store Account is registered in, not the country you are currently in.  Access may not be available in all countries.  Family sharing and sharing across devices may be limited by the App Store or Play Store or by your personal settings. 

After 1 year, subscriptions will no longer renew.  There is no guarantee a 'display ad free' version of the app will be available after the 1 year period.

Purchases are governed by the App Store and/or Play Store terms and conditions, and refunds are managed through the App Store or Play Store. MetService does not have access to PII or individual payment details.

"Display ad free" means that ads served through an ad server, such as interstitials, display banners, MRECs etc will be hidden for those who have paid for a 'display ad free' subscription and who have the 'hide ads' toggle enabled in the premium subscription settings. 

MetService contracts with third parties to incorporate content, whether owned by the third party or owned by MetService and sponsored by third parties, in our app.    Content sponsorship attributions and logos will continue to be shown when the user has purchased a 'display ad free' subscription.

Privacy

You accept that you have read and agreed to MetService’s Privacy Policy. If you have any privacy concerns regarding the Apps, please write to our Privacy Officer at privacy@metservice.com. More information is available about your privacy rights in New Zealand through the Office of the Privacy Commissioner.

Governing Law

These Terms are governed by and construed in accordance with the Laws of New Zealand and are subject to the non-exclusive jurisdiction of the New Zealand courts.

General

If MetService does not exercise or enforce any rights available to it under these Terms, it does not constitute a waiver of those rights.

If any part or provision of these Terms is illegal, invalid, or unenforceable, that part or provision is replaced with a provision which, as far as possible, accomplishes the original purpose of that part or provision. The remainder of these Terms will be binding on you.

These Terms supersede all previous conditions, understandings, commitments, agreements, and representations whatsoever whether oral or written, and constitutes the entire agreement between you and MetService relating to the subject matter of these Terms.
